This agreement is made and entered into this ______day of
_____________200___ by and between Jennifer Poole (hereafter "seller"),
and _______________________________________(hereafter "Buyer"), for the
purpose of setting forth the terms and conditions of the purchase of a
purebred American Staffordshire Terrier puppy from the litter whelped
on ________________ out of ________________________and____________________
For good and valuable consideration, the Seller agrees to purchase
one______Male______Female puppy from the litter described above, AKC
Registration #__________________, subject to the following:

1. Seller warrants that the above described puppy is a purebred
American Staffordshire Terrier, registable with the AKC and that
registration papers_____have_____have not been provided to the Buyer.
**Please Note** Companion/Pet Home puppy will have limited
registration papers. NO EXCEPTIONS! The said puppy must be spayed
or neutered by at least one year of age and a copy of the spay/neuter
certificate must be presented to the seller upon request. Breeding of the
above described puppy breaks this contract.
2. Seller warrants that the above described puppy is in good health at the
time Buyer assumes ownership. Buyer agrees to have the puppy
examined by a licensed Veterinarian within two (2) working days of
receipt of puppy. If, as a result of the examination, the Veterinarian
determines that the puppy is not in good health, the Buyer may elect to
return the puppy. Buyer shall, within 10 days after the date of the
signing of this contract, send to the Seller by certified mail, a written
Veterinarians's certificate, stating that the puppy was in ill health when
examined. Upon receipt by Seller of certificate, the Buyer shall be
obligated to return the puppy to Seller at Buyer's expense. Upon receipt
of the puppy, the Seller shall be obligated to refund all monies received
from the Buyer toward the purchase of the puppy and futher
performance under this contract shall be null and void. All actions
taken to return the puppy shall be done with the best interest of the
puppy in mind, including temperature at the time of shipment,
non-stop flights, etc.
3. The above described puppy is guaranteed not to be aggressive at time
of transfer to the buyer. The above described puppy should receive
proper socialization with other humans and animals throughout it's
lifetime as well as consistent obedience training and gentle but firm
discipline, in order to maintain a sound temperment and proper social
skills. The seller is not responsible for any type of damage and/or
injuries that above described puppy causes.
4. Ownership of the puppy will be transferred to the Buyer for the sale
price of $___________. Seller warrants that every reasonable effort has
been made to assure that the sire and dam of above described puppy,
are of sound temperment and in good health.**NOTE: A $250.00
Non-Refundable Deposit is required to hold a puppy. The remaining
balance must be paid in FULL by the time the puppy stated above
reaches (6) weeks of age or Deposit is forfeited.**
5.If delivery is requested by the Buyer, it shall be by airfreight to the
designated location. Buyer is solely responsible for all costs of crate,
insurance during shipment and cost of airfreight service charges.
6.The above described puppy shall carry the Sprucehill Kennel name.
7. Buyer agrees that he/she is not acting as an agent in the purchase of
this puppy and the Buyer will not sell this puppy or any of it's progeny
to any agent, pet store, guard dog business or research facility.
8.Buyer agrees that if it becomes necessary to sell or otherwise dispose
of this puppy, Buyer will notify the Seller before taking any such action
so that the puppy may, at the Sellers option, be repurchased by the
Seller, at the original purchase price listed above. Upon notification, the
Seller shall have 15 working days to exercise said repurchase option.
Exercise of option shall be notice in writing sent to Buyer.
9. Buyer agrees that the puppy will have as it's permanent residence, the
home of the Buyer, have access to a fenced area, not be chained or
tethered and will be provided with proper housing,diet and exercise.
Buyer agrees to provide adequate veterinary care, including but not
limited to annual checkups and heartworm tests; to keep all
immunizations current, according to the American Veterinary Medical
Association guidelines, and properly administer heartworm
preventative. Buyer agrees that at least one (1) basic obedience course
will be completed within six (6) months of the purchase of the above
described puppy.
10. Other Terms__________________________________________________________
11.Buyer agrees to immediately notify the seller of any changes in
address, phone number or email address. The buyer agrees to stay in
reasonable contact with the Seller and update the Seller about the puppy
stated above.
12. Violation of the terms of this contract that could negatively impact
this puppy's health, safety or well-being shall result in Buyer being
required to return the puppy to the Seller within (5) days of receipt of
notice from Seller. Buyer will be responsible for the cost of the puppy's
transportation back to Seller. Seller is under no obligation to refund
any monies to Buyer. If the above terms are not met, an amount of
$5,000.00 (Five Thousand Dollars) shall be considered settlement of the
above contract.
13. Should Buyer violate this agreement, he/she will be responsible for
all legal costs incurred by Seller in enforcing this agreement.

This agreement is made and signed by both parties to insure the well
being and protection of this puppy. If any part of this Agreement is
breached by the Buyer, Seller is released from any obligations under
this Agreement.
